G4G TERMS OF USE


These are the basic rules about using Go for the Goal. Please read them before you use the site. These rules came into effect on Jan. 1, 2015. They will be updated as needed. They’re pretty basic and reasonable, so be a nice human and we’ll all get along!

Welcome to Go for the Goal!

This page explains our terms of use. When you use Go for the Goal, you’re agreeing to all the rules on this page. Some of them need to be expressed in legal language, but we’ve tried to offer clear and simple explanations of what everything means.

By using this website (the “site”) and services (together with the site, the “services”) offered by Go for the Goal/G4G Equestrian Services Inc. (together with its parents, subsidiaries, affiliates, agents, representatives, consultants, employees, officers, and directors — collectively, “G4G,” “we,” or “us”), you’re agreeing to these legally binding rules (the “terms”). You’re also agreeing to our Privacy Policy [add link] and agreeing to follow any other rules on the site.

We may change these terms from time to time. If we do, we’ll let you know about any material changes, either by notifying you on the site or by sending you an e-mail. New versions of the terms will never apply retroactively — we’ll tell you the exact date they go into effect. If you keep using Go for the Goal after a change, that means you accept the new terms.

In these terms, we refer to those raising funds as “campaign owners" and to their fundraising campaigns as “campaigns." We refer to those contributing funds as “sponsors” or “contributors” and to the funds they contribute as “contributions." Campaign owners, contributors and other visitors to the service are referred to collectively as “users."

Go for the Goal is an online crowd funding venue for equestrians and equestrian related people, entities or activities seeking to raise funds for their own campaigns and to contribute to the campaigns of others. Campaign owners can offer gifts or rewards in the form of tangible items or intangible services (collectively, “rewards.”) to contributors. Rewards are not offered for sale. Go for the Goal makes no representations about the quality, safety, morality or legality of any campaign, reward or contribution or the truth or accuracy of your user content (as defined below) posted on the service. Go for the Goal does not represent that campaign owners will deliver rewards or that contributions will be used as described in the campaign. Users use the service at their own risk.

ABOUT CREATING AN ACCOUNT

To sign up for a Go for the Goal account, you need to be 18 or over, or using the account under adult supervision. You’re responsible for your account and all the activity on it.

You can browse Go for the Goal without registering for an account. But to use some of the Go for the Goal functions, you’ll need to register, choose an account name, and set a password. When you do that, the information you give us has to be accurate and complete. Don’t impersonate anyone else or choose names that are offensive, rude, or that violate anyone’s rights. If you don’t follow these rules, we may cancel and delete your account.

You’re responsible for all the activity on your account, and for keeping your password confidential. If you find out that someone has used your account without your permission, you should report it to privacy@goforthegoal.ca.

To sign up for an account, you need to be at least 18 years old, or old enough to form a binding contract where you live, or under the supervision of an adult. If necessary, we may ask you for proof of age.

ELIGIBILITY TO USE THE SERVICE


You are not eligible to use the Service without consent if you are under 18 years of age. If you are between the ages of 13 and 17, you can use the Service with the consent and supervision of your parent or legal guardian who is at least 18 years old, provided that your parent or legal guardian also agrees to be bound by the terms and agrees to be responsible for your use of the service. You are not eligible to use the service if you have previously been suspended from using the service for any reason and we have not explicitly authorized you to resume using the service. We reserve the right to refuse use of the service to anyone and to reject, cancel, interrupt, remove or suspend a campaign or the service at any time for any reason without liability.

PROHIBITED CAMPAIGNS

Campaign owners are not permitted to create a campaign to raise funds for illegal activities, to cause harm to people or property, or to scam others. If you know that your campaign is claiming to do the impossible or it's just plain phoney, don't post it. You must comply with all applicable laws and regulations in connection with your campaign, including offering rewards and using contributions.

PROHIBITED REWARDS


Campaign owners are not permitted to offer or provide any of the following as a reward:
Any form of capital, equity or other similar ownership interest in a company or venture;
Any form of financial incentive;
Any alcoholic consumer products (vouchers or memberships offering physical delivery of alcoholic consumer products are permitted);
Any controlled substance or drug paraphernalia; weapons, ammunition and related accessories;
Any form of lottery or gambling;
Any form of air transportation;
Any items promoting hate, discrimination, personal injury, death, damage, or destruction to property; or any items (a) prohibited by applicable law to possess or distribute, (b) that would violate applicable law if distributed, or (c) that would result in infringement or violation of another person's rights if distributed.


THINGS YOU DEFINITELY SHOULDN'T DO

This section is a list of things you probably already know you shouldn’t do — lie, break laws, abuse people, steal data, hack other people’s computers, and so on. Please behave yourself.
We hope millions of people will use Go for the Goal. We expect everyone to behave responsibly and help keep this a nice place. Or we will cancel or delete your account.

Don’t do any of these things on the site:

Don’t break the law.
Don’t take any action that infringes or violates other people’s rights, violates the law, or breaches any contract or legal duty you have toward anyone.
Don’t lie to people.
Don’t post information you know is false, misleading, or inaccurate.
Don’t do anything deceptive or fraudulent.
Don’t offer prohibited items.
Don’t offer any rewards or perks that are illegal, violate any of our policies, rules, or guidelines, or violate any applicable law, statute, ordinance, or regulation.
Don’t victimize anyone.
Don’t do anything threatening, abusive, harassing, defamatory, libellous, tortious, obscene, profane, or invasive of another person’s privacy.
Don’t spam.
Don’t distribute unsolicited or unauthorized advertising or promotional material, or any junk mail, spam, or chain letters.
Don’t run mail lists, listservs, or any kind of auto-responder or spam on or through the site.
Don’t harm anyone’s computer.
Don’t distribute software viruses, or anything else (code, films, programs) designed to interfere with the proper function of any software, hardware, or equipment on the site (whether it belongs to Go for the Goal or another party).
Don’t abuse other users’ personal information. When you use Go for the Goal — and especially if you create a successful campaign — you may receive information about other users, including things like their names, e-mail addresses, and postal addresses. This information is provided for the purpose of participating in a Go for the Goal campaign: don’t use it for other purposes, and don’t abuse it.

We also need to make sure that the site is secure and our systems function properly. So don’t do any of these things — most of which boil down to “don’t mess with our system.”
Don’t try to interfere with the proper workings of our services.
Don’t bypass any measures we’ve put in place to secure the services.
Don’t try to damage or get unauthorized access to any system, data, password, or other information, whether it belongs to Go for the Goal or another party.
Don’t take any action that imposes an unreasonable load on our infrastructure, or on our third-party providers. (We will decide what’s reasonable.)
Don’t use any kind of software or device (whether it’s manual or automated) to “crawl” or “spider” any part of the site.
Don’t take apart or reverse engineer any aspect of Go for the Goal in an effort to access things like source code, underlying ideas, or algorithms.


DISPUTES BETWEEN CAMPAIGN OWNERS AND CONTRIBUTORS


Campaign owners are legally bound to fulfill any rewards. Go for the Goal is under no obligation to become involved in disputes between campaign owners and contributors or sponsors, or users and any third party.
In the event of any dispute, such as a campaign owner's alleged failure to comply with the terms or alleged failure in fulfillment of a reward, we may provide the campaign owner's contact information to the contributor so that the two parties may resolve their dispute.

The key thing is: If you’re running a campaign, fulfill your promises.

OUR LICENSE TO YOU


Go for the Goal grants you a limited, non-exclusive, non-transferable, revocable licence to use the service subject to your eligibility and your continued compliance with these terms.


CAMPAIGN OWNERS


As a campaign owner, you are permitted to offer rewards to contributors. You shall meet all commitments you make in your campaign including, but not limited to, delivering all rewards you offered with your campaign. You will respond promptly and truthfully to all questions posed to you by Go for the Goal or any contributor or sponsor. If you are unable to fulfill any of your commitments to contributors (including delivering any rewards), you will work with the contributors to reach a mutually satisfactory resolution, which may include refunding their contributions. You will comply with all applicable laws and regulations in your use of contributions and delivery of rewards. You are responsible for collecting and remitting any taxes on contributions, and any taxes due in connection with your rewards.
Go for the Goal may attempt to verify your identity and other information you provided to us, and we may delay, withhold, reverse or refund any contributions or other amounts without notice or liability in the event we are unable to verify any information to our satisfaction.

CONTRIBUTORS OR SPONSORS

As a contributor or sponsor, you are solely responsible for asking questions and investigating campaign owners and campaigns to the extent you feel is necessary before you make a contribution. All contributions are made voluntarily and at your sole discretion and risk. Go for the Goal doesn't guarantee that contributions will be used as promised, that campaign owners will deliver rewards, or that the campaign will achieve its goals. Go for the Goal does not endorse, guarantee, make representations, or provide warranties for or about the quality, safety, morality or legality of any campaign, reward or contribution, or the truth or accuracy of content posted on the service.
You are solely responsible for determining how to treat your contribution and receipt of any rewards for tax purposes.
In the event you are issued a refund on your contribution because of our inability to disburse funds to a campaign owner, you will no longer be entitled to delivery of any reward associated with your contribution.

FEES AND PAYMENTS


Setting up an account on the service is free. We do not charge fees to contributors or sponsors, but we do charge fees to campaign owners as a portion of the funds they raise.
By using the service you agree to our fees listed on this site.
Changes to fees are effective after we post notice of the changes on the service. Updated fees are applied to campaigns launched after the notice is posted. You are responsible for paying all taxes associated with your use of the service. Contributions are made via PayPal. We are not responsible for the performance of PayPal or any third party credit card processing services.

 

REFUNDS


Contributions, along with our fees and charges, are not refundable.


TAXES


Your taxing authorities may classify funds you raise on Go for the Goal as taxable income to you and any beneficiary who will receive funds directly from your campaign.

We will provide you with a receipt if required by the relevant taxing authorities.

We encourage you to consult with a licensed tax advisor from your local jurisdiction when planning your campaign so that you understand and prepare for the tax obligations you may incur from the funds you raise.

YOUR USER CONTENT


While using the service, you may post photos, videos, text, graphics, logos artwork and other audio or visual materials (collectively, “user content"). You grant Go for the Goal a perpetual, non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to use, publicly display, publicly perform, store, reproduce, modify, create derivative works, and distribute your user content on or in connection with the service and our related marketing and promotional activities.

As between you and Go for the Goal, you continue to hold all ownership interest in your user content. You represent and warrant that your user content and our use of your user content will not infringe any third party's intellectual property rights, proprietary rights, privacy rights, confidentiality, rights of publicity or otherwise violate these terms or applicable law.


THIRD-PARTY WEBSITES, ADVERTISERS OR SERVICES 

The service may contain links to third-party websites, advertisers, or services that are not owned or controlled by Go for the Goal. Access to or use of third-party sites or services are at your own risk. We are not responsible for any loss or damage of any sort relating to your dealings with these parties. We encourage you to be aware of when you leave the Service, and to read the terms and conditions and privacy policy of any third-party website or service that you visit.
